GUIDELINES REGARDING WHO IS ELIGIBLE FOR THE WAH PROVISION
The WAH provision is exactly that... a work-at-home provision, not a
home use provision. This means that by an employee taking this software
home you are acknowledging that they are performing UF work at their home.
In order to verify this, approval from an immediate supervisor before
distribution of the software should be sought.
Anyone that receives a paycheck from the University is eligible for the
WAH provision. This does not mean, however, that anyone that receives a
paycheck should be allowed to install this software at their home.
Exempt employees are not subject to the wage and hour laws of the Fair
Labor Standards Act. Thus,
usage of the WAH provision is not contingent on other requirements besides
verifying that UF work is being performed at home.
Non-exempt employees ARE subject to the wage and hour laws and thus
there are additional considerations regarding usage of the WAH provision.
This does not prevent distribution of the software to non-exempt employees.
However, it should caution you before doing so.
Non-exempt employees that are provided the software under the WAH
provision should meet the criteria and have the approvals subject to the Alternate Work Location Policy so their
work at home can be properly documented and compensated.
GUIDELINES REGARDING WHAT MEDIA / VOLUME LICENSE KEYS (VLK) TO DISTRIBUTE
As of the last statement made by UF administration
regarding issuance of this software under the WAH provision it is okay to distribute the media
and VLKs from the licensing.microsoft.com website. It is my opinion that
this open policy does not coincide with the letter and spirit of the campus
license agreement that I've been able to find on Microsoft's website. (UF
may have some special considerations / addendums on its contract however.)
As a result, we offer the following guidelines regarding media and the WAH
provision.
Create a good-faith and honesty statement which should be signed by the
individual receiving the software. This statement should describe the
basic rules of the license (including a clear statement requiring the
removal of the software upon leaving the University).
Wherever possible require usage of WAH media kits. This provides the
necessary security of the University VLKs and prevents college IT staff
from being involved in the installation process.
Because university VLKs would be accessible in the Window's registry,
distribution of volume license media is strongly discouraged. Establish
adequate safeguards to prevent abuse of the license if using volume license
media/keys for the WAH provision. For instance, do not provide the media,
instead require the system to be brought in or require remote access for
installation of the software through a network connection by unit IT staff.
PRICING AND ACQUISITION OF WAH KITS
The WAH media kits will come with a one-use license key that
requires registration (similar to full-package product). This
will prevent abuse of the WAH provision, protect the volume
license keys and is why WAH media kits are recommended. Each
WAH media kit will have a unique license key. There are three ways to
obtain WAH media kits:
MIS has begun purchasing WAH media kits in bulk in order to have them on hand for easy
distribution within the College. However, we are not doing this for free. You will be asked
to supply your unit's chart field string in order to process an E2E against the original
purchase. Please fill out the WAH Media Kit Request
form and send it through campus mail to MIS at PO Box 116550. Upon receiving the form the
MIS software license coordinator will contact you to verify the order and arrange to send you the
requested software. We are only keeping on hand the more popular software (Windows XP Pro
and Office 2003).
